DMCA Copyright Policy

Our Commitment

DearHim, Inc. respects the intellectual property rights of others and expects users of the Service to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA," 17 USC §512), we have implemented this policy for receiving and processing copyright infringement notices.


Submitting a DMCA Takedown Notice

If you believe content available on or through our Service infringes a copyright you own (or are authorized to act on behalf of), please submit a notice to our Designated DMCA Agent that contains the following elements (required by 17 USC §512(c)(3)):

  1. A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work claimed to have been infringed (e.g., title, registration number, link to original work).
  3. Identification of the material that is claimed to be infringing and information reasonably sufficient for us to locate it (URL, screenshot, content description).
  4. Your contact information: name, address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on behalf of the owner.

We will not respond to incomplete notices or notices submitted to other addresses.


What Happens After You Submit a Notice

When we receive a complete DMCA takedown notice:

  1. We review the notice for the required elements above.
  2. If the notice is complete and appears valid, we expeditiously remove or disable access to the allegedly infringing material.
  3. We notify the user who posted the material that their content has been removed and provide them a copy of your notice (with your contact information so they can submit a counter-notification if appropriate).
  4. We may track repeat infringement and terminate accounts of users who repeatedly infringe.

We do not pre-screen user content for copyright infringement. We respond to DMCA notices as we receive them.


Counter-Notification Procedure

If your content was removed in response to a DMCA notice and you believe it was removed in error or that you have the right to use the material, you may submit a counter-notification. Per 17 USC §512(g)(3), a valid counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed and the location at which it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your contact information: name, address, telephone number, and email address.
  5. A statement that you consent to the jurisdiction of the federal district court in the judicial district where you are located (or, if outside the US, in any judicial district in which DearHim, Inc. may be found), and that you will accept service of process from the person who provided the original DMCA notice or their agent.

Submit counter-notifications to dmca@dearhim.ai with the subject line "DMCA Counter-Notification".

When we receive a complete counter-notification:

  1. We forward it to the original notifier.
  2. If the original notifier does not file a court action seeking a restraining order against the user within 10 business days, we will restore the material in not less than 10 and not more than 14 business days from receipt of the counter-notification.

Repeat Infringer Policy

In accordance with 17 USC §512(i), we maintain a policy of terminating accounts of users who are determined to be repeat infringers. We may consider a user to be a "repeat infringer" if they receive multiple valid DMCA takedown notices, the specific number depending on the severity and pattern of infringement.


False Claims Are Subject to Penalties

Submitting a fraudulent DMCA notice or counter-notification is illegal. Per 17 USC §512(f), any person who knowingly materially misrepresents:

  • That material is infringing, or
  • That material was removed by mistake or misidentification,

shall be liable for any damages, including costs and attorneys' fees, incurred by the alleged infringer, by any copyright owner, or by their licensees, who is injured by such misrepresentation, as a result of our reliance on the misrepresentation in removing or replacing the material.

If you are unsure whether the material in question constitutes infringement or whether you have the right to file a notice or counter-notification, consult an attorney before submitting.


AI-Generated Content

Our Service generates AI characters, images, voice notes, and text using artificial intelligence. We design these systems to avoid producing output that incorporates copyrighted works without authorization. However, AI systems are not perfect.

If you believe AI-generated output on our Service infringes your copyright, you may submit a DMCA notice as described above. Please:

  • Identify the specific output you believe is infringing.
  • Identify the original copyrighted work.
  • Explain the basis of your claim (e.g., is the AI reproducing your work, is it generating substantially similar output, is the AI imitating your distinctive style, etc.).

We take such claims seriously and will investigate. Note that some claims (e.g., that AI-generated output in the "style of" an artist infringes that artist's copyright) involve unsettled areas of law. Where the law is unclear, we may decline to remove content but will engage in good-faith dialogue.


DearUs User Content

For DearUs profiles and user content, the same DMCA process applies. If a user has uploaded a photo, image, or text that you believe infringes your copyright, submit a DMCA notice and we will process it accordingly. We may also independently investigate and remove content that violates our Community Guidelines, including unauthorized use of others' photos.


Trademarks

This Policy applies to copyright. For trademark concerns (e.g., believing we or a user is infringing your trademark), contact legal@dearhim.ai with subject "Trademark Concern".
